I finally had some time to peruse the 100+ pages of declarations filed by Orange County earlier this week for the Bay Lake Tower at Disney's Contemporary Resort. Following are a few observations regarding the terms and conditions contained within these documents.
To be honest, the terms listed in these recent filings are pretty consistent with other Disney Vacation Club resorts. However, given the years worth of speculation to which we have been subjected, this information may help dispel a few myths that have been making the rounds.
- The expiration of the Ground Lease is listed as January 31, 2060. Assuming the familiar 50-year contract, this would suggest a resort opening in late-2009 or early 2010.
- Disney Vacation Club Management Corporation is to be paid a fee equal to 12% of member dues (less transportation and property taxes) for running the program. This figure is consistent with all other DVC resorts.
- The home resort priority period terms are identical to other resorts. It states that the period is currently four months (the span between the 11-month Home booking window and the 7-month non-home window), and will always be no less than one month.
- Disney Vacation Development is permitted to sell up to 98% of all declared points at the resort. Again this is consistent with other resorts. The 2% ownership is retained by DVD to be used for room maintenance purposes. Effectively this gives them the ability to take each guest room out of service for one week per year.
- The Definitions section lists a One Bedroom villa as containing one bathroom and a Two Bedroom villa as containing two bathroos. These would appear to be old definitions. The floorplans (LINK) clearly demonstrate the presence of two full bathrooms in the One Bedroom villas and three bathrooms in Two Bedroom villas.
- The Maximum Reallocation point charts are identical to those filed with other governmental bodies back in February (LINK.) The published values suggest a slight increase to stay at night at the Bay Lake Tower compared to all other resorts. Some rumors have suggested that DVD was considering a greater increase subsequent to the February filing, but the similarities here suggest that may not be true.
